TERMS AND CONDITIONS OF USE

Use of the Sites constitutes consent to the application of those laws, as well as of the following terms and conditions, including the Privacy Policy and the Disclaimer (collectively the "Terms and Conditions"). If you do not agree to any of the said Terms and Conditions, please do not use the Sites.

Mari's Foods Inc. ("Mari's Foods") has the right to amend the Terms and Conditions at any time, from time to time, and in any way, and may do so without prior notice. Any such modification shall be effective upon it being posted on the Sites. By your access of the Sites, you agree to periodically review the Terms and Conditions and you agree that you shall be bound by any such future modifications.

While visiting the Sites you may not: post, upload, publish, reproduce, transmit or otherwise distribute information or other material: (i) constituting or encouraging conduct that would constitute a criminal offense or give rise to civil liability; (ii) which is protected by copyright, other intellectual property right or derivative works with respect thereto, without obtaining permission of the copyright owner or rightholder; or (iii) otherwise use the Sites in a manner which is contrary to law, including by posting or transmitting any information or software which contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component.

The trademarks, logos and service marks, including but not limited to Mari's Foods, www.dressdipmarinate.com, www.howdoyouwafu.com, www.marifoods.com, www.marifoods.net, www.vinaigrettewafu.com, www.wafu.ca, www.wafu.co.in, www.wafu.com.es, www.wafu.com.mx, www.wafu.de.com, www.wafu.eu.com, www.wafu.qc.com, www.wafu.us, www.wafu.us.com, www.wafusauce.com, www.wafusauce.net, www.wafuvinaigrette.com, and other names, logos and icons identifying Mari's Foods, its affiliates and their respective products and services, including WAFU® (collectively the "Trademarks") displayed on the Sites, are registered and unregistered trademarks of Mari's Foods, its affiliates and others, as the case may be. Nothing contained on the Sites should be construed as granting any license or right to use any Trademark displayed on the Sites without the written permission of Mari's Foods or such third party that may own the Trademarks. Your misuse of the Trademarks displayed on the Sites, or any other content on the Sites is strictly prohibited. You are also advised that Mari's Foods will enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

PRIVACY POLICY

The present policy ("Privacy Policy") regulates your access and use of the Sites and serves to inform you of our policy pertaining to the collection, use and disclosure of information that you may provide by your use of the Sites.

Collection of Information and consent

The Sites may actively collect information from visitors by asking specific questions as well as by giving visitors the opportunity to communicate with us by e-mail via the Sites. Furthermore, should registration to the Sites be available, it will be necessary for you to submit certain personally identifiable information, as described below, in order to register.

We may use your information to improve our products, services and our Sites, for marketing, promotional or research purposes or to communicate product information and other information pertaining to Mari's Foods and its affiliates.

You authorize Mari's Foods to collect and to retain all relevant information relating to your use of the Sites and you hereby authorize any party to provide us with such information. You understand and agree that unless you notify Mari's Foods to the contrary by e-mailing us, you further authorize us to disclose, on a confidential basis, to any party with whom Mari's Foods has business relations, all relevant information relating to your dealings with us and the Sites.

Children

It is not our goal nor intention to collect information pertaining to persons under the age of eighteen ("Children"). However, it is possible that we nevertheless collect such information if same is provided to us. We therefore encourage parents to inform their Children about the possible consequences of using the Sites and disclosing information through the said Site. We will not assume any responsibility with respect to the use of the Sites or disclosure of information via the Sites by Children. Children are hereby required to obtain the permission of their parent or legal guardian before providing any personally identifiable information to us.

Cookies

For each visitor to the Sites, our web server may automatically recognize and store information such as the visitor's IP address/domain name combination, type of web browser and any referring web sites. When you visit the Sites, our server may send a "cookie" (small amount of Data) to your browser. In addition, a link to a web site does not mean that Mari's Foods endorses or accepts any responsibility for the content, or the use, of such web site. Mari's Foods and its affiliates take no responsibility for the accuracy, validity or suitability for any purpose of any claims or statements contained in the information, or related graphics of the Sites, which are all provided without warranty of any kind.

By using the Sites, you agree that your access to the Sites and / or use of its contents is at your own risk. WAFU® DONATIONS TO THE JAPAN EARTHQUAKE FUND

As of March 15, 2011, Mari's Foods Inc. (the "Company"), entered into a Disaster Funding Agreement with The Canadian Red Cross Society, under which the Company agreed to donate funds to the Canadian Red Cross JAPAN EARTHQUAKE FUND in the following manner. The Company agreed to donate 10¢ for every 290 mL and 480 mL bottle of Wafu® Japanese Vinaigrette estimated to be sold in Canada during the period of March 18, 2011 to May 13, 2011, to the Canadian Red Cross JAPAN EARTHQUAKE FUND, up to a maximum donation of CDN $3,000. In addition, the Company agreed to donate to the Canadian Red Cross JAPAN EARTHQUAKE FUND an additional 5¢ for every new "Like" on the Wafu® Japanese Vinaigrettes Facebook page and 5¢ for every new Twitter follower on Wafu®'s Twitter page @WafuBrand during this period, up to a maximum of 20,000 new "Likes" on Facebook (CDN $1,000) and a maximum of 20,000 new Twitter followers (CDN $1,000).

The Canadian Red Cross JAPAN EARTHQUAKE FUND is operated and administered by the Canadian Red Cross Society (the "Society"). The Society is a not-for-profit volunteer-based humanitarian organization dedicated to helping people in Canada and around the world with situations that threaten their survival and safety, their security and well-being, or their human dignity. The Society which is incorporated without share capital under the laws of Canada, is a registered Canadian charity and, as such, is exempt from income taxes. For more information on the Society, please refer to the Society's website at www.redcross.ca.

Neither Mari's Foods Inc. nor any of its shareholders, board of directors, and/or employees are affiliated or associated with the Society. The Company makes no representation or warranty, explicit or implicit, as to, and takes no responsibility for, the manner and the extent to which any funds donated to the Canadian Red Cross JAPAN EARTHQUAKE FUND will be actually spent and/or allocated by the Society.

The logos, names and trademarks of the Society are protected by Canadian copyright and trademark laws, and are used herein by the Company with the prior approval of the Society.
